WhatsApp चैट कोर्ट में कैसे पेश करें

क्या WhatsApp चैट सबूत बन सकती है, यह अब असली सवाल नहीं रह गया है। असली सवाल यह है कि उसे किस तरह पेश किया जाए कि अदालत उसे स्वीकार भी करे और उसका वज़न भी बने। पूरी प्रक्रिया, क्रम से।

पहले यह समझ लीजिए कि किस चीज़ का प्रमाणपत्र बनता है

ज़्यादातर लोग चैट का प्रिंटआउट लेकर आते हैं और उसी पर प्रमाणपत्र बनवाना चाहते हैं। नया कानून इस तरह काम नहीं करता। अनुसूची रिकॉर्ड का हैश मूल्य माँगती है, और प्रिंटआउट का हैश किसी काम का नहीं होता। इसलिए असल में जिस चीज़ का प्रमाणपत्र बनता है वह है एक्सपोर्ट की गई फ़ाइल, और ट्रांसक्रिप्ट उसी का पढ़ने योग्य रूप है।

इसका सीधा नतीजा यह है कि क्रम मायने रखता है: पहले एक्सपोर्ट, फिर हैश, फिर प्रमाणपत्र। बीच में फ़ाइल को खोलकर सेव करना, अनज़िप करके दोबारा ज़िप करना या PDF में बदलना — इनमें से कोई भी काम हैश बदल देता है और प्रमाणपत्र उस फ़ाइल का रह ही नहीं जाता।

चरण 1 — चैट एक्सपोर्ट कीजिए

Android

  1. WhatsApp खोलिए और वह बातचीत खोलिए जो पेश करनी है।
  2. ऊपर दाईं ओर तीन बिंदु (⋮) दबाइए।
  3. MoreExport chat चुनिए।
  4. Include media (मीडिया सहित) या Without media (मीडिया रहित) चुनिए।
  5. फ़ाइल को Files या Drive में सेव कीजिए — किसी चैट ऐप पर भेजकर नहीं।

iPhone

  1. बातचीत खोलिए और सबसे ऊपर संपर्क या ग्रुप के नाम पर टैप कीजिए।
  2. नीचे तक स्क्रॉल करके Export Chat चुनिए।
  3. Attach Media या Without Media चुनिए।
  4. शेयर मेन्यू में Save to Files चुनिए।

मीडिया सहित एक्सपोर्ट में .zip मिलती है जिसमें ट्रांसक्रिप्ट और अटैचमेंट दोनों होते हैं; मीडिया रहित में सिर्फ़ एक .txt। अगर फ़ोटो, वॉइस नोट या दस्तावेज़ भी सबूत हैं तो मीडिया सहित ही लीजिए।

ध्यान रखने लायक बातें

चरण 2 — फ़ाइल का SHA-256 हैश निकालिए

हैश फ़ाइल की डिजिटल उँगलियों की छाप है। एक भी बाइट बदलने पर पूरा हैश बदल जाता है। Pune Bar Association बनाम भारत संघ (2026) में सर्वोच्च न्यायालय ने कहा कि इलेक्ट्रॉनिक डेटा का हैश मूल्य “इलेक्ट्रॉनिक फ़िंगरप्रिंट का पर्याय है”। अनुसूची का भाग A यही मूल्य माँगता है।

Windows पर Command Prompt खोलकर:

certutil -hashfile "C:\path\to\WhatsApp Chat.zip" SHA256

macOS या Linux पर:

shasum -a 256 "/path/to/WhatsApp Chat.zip"

64 अक्षरों का जो मान मिले, उसे लिख लीजिए और एल्गोरिदम का नाम (SHA-256) भी साथ लिखिए। यह वही मान होना चाहिए जो प्रमाणपत्र में लिखा जाए। दूसरा पक्ष और अदालत इसी आदेश से इसे दोबारा जाँच सकते हैं — विस्तार से: हैश कैसे जाँचें (अंग्रेज़ी में)

एक बात साफ़ रहनी चाहिए: मिलता हुआ हैश सिर्फ़ यह बताता है कि फ़ाइल तब से बदली नहीं है। यह यह नहीं बताता कि फ़ाइल WhatsApp से ही निकली है, किसी टेक्स्ट एडिटर में बनाई नहीं गई। यही वह कमी है जिसे कोई भी सॉफ़्टवेयर पूरी तरह नहीं भर सकता, और यही भाग B के होने की वजह है।

चरण 3 — धारा 63(4) का प्रमाणपत्र भरिए

प्रमाणपत्र दो भागों में होता है।

भाग A — रिकॉर्ड पेश करने वाले व्यक्ति का प्रमाणपत्र

इस पर वह व्यक्ति हस्ताक्षर करता है जिसके वैध नियंत्रण और नियमित उपयोग में वह डिवाइस उस अवधि में था। यानी आम तौर पर वही पक्षकार जिसके फ़ोन से एक्सपोर्ट लिया गया — उसका वकील नहीं, क्लर्क नहीं, और मदद करने वाला रिश्तेदार नहीं। भाग A में यह कहा जाता है:

  1. रिकॉर्ड उस डिवाइस से निकाला गया जो उस अवधि में मेरे वैध नियंत्रण और नियमित उपयोग में था;
  2. डिवाइस ठीक से काम कर रहा था, और अगर कोई ख़राबी थी तो उससे रिकॉर्ड की सामग्री या शुद्धता प्रभावित नहीं हुई;
  3. रिकॉर्ड में जो जानकारी है वह सामान्य कामकाज के दौरान डिवाइस में आई जानकारी से बनी है;
  4. नीचे लिखा हैश मूल्य उसी रिकॉर्ड पर निकाला गया है।

भाग B — विशेषज्ञ का प्रमाणपत्र

भाग B पर एक विशेषज्ञ हस्ताक्षर करता है और तकनीकी विवरण — हैश, एल्गोरिदम, फ़ाइल और डिवाइस के ब्योरे — की पुष्टि करता है। मद्रास उच्च न्यायालय का मत था कि यह केवल सूचना प्रौद्योगिकी अधिनियम की धारा 79A के तहत अधिसूचित परीक्षक ही कर सकता है। Pune Bar Association (2026) में सर्वोच्च न्यायालय ने इससे असहमति जताई और कहा कि कंप्यूटर विज्ञान और साइबर फ़ोरेंसिक में विशेष कौशल रखने वाला व्यक्ति भी विशेषज्ञ माना जा सकता है, बशर्ते अदालत ठोस सामग्री पर उसकी विशेषज्ञता से संतुष्ट हो। न्यायालय ने यह क़ानूनी प्रश्न स्पष्ट रूप से खुला रखा है।

इससे दो व्यावहारिक बातें निकलती हैं: भाग B को खाली मत छोड़िए, और विशेषज्ञ से हैश ख़ुद निकलवाइए — दिया हुआ मान अपना लेना भाग B के कथन को ही झूठा बना देता है।

चरण 4 — अनुसूचियाँ भरिए

घोषणा छोटी है क्योंकि ब्योरा अनुसूचियों में जाता है। दो हिस्से होते हैं:

यही वे ख़ाने हैं जो सबसे ज़्यादा खाली छोड़े जाते हैं, और यही प्रमाणपत्र को मज़बूत बनाते हैं। भरे हुए ब्योरे के ख़िलाफ़ दूसरे पक्ष को मेहनत करनी पड़ती है; खाली ब्योरे के ख़िलाफ़ सिर्फ़ सवाल पूछना काफ़ी है।

चरण 5 — दाखिल कीजिए

अदालत में चार चीज़ें साथ जाती हैं:

प्रमाणपत्र रिकॉर्ड के साथ ही दाखिल कीजिए। Arjun Panditrao Khotkar (2020) में सर्वोच्च न्यायालय ने पुराने प्रावधान पर यह तय किया था कि द्वितीयक इलेक्ट्रॉनिक साक्ष्य के लिए प्रमाणपत्र अनिवार्य है, और बाद में प्रमाणपत्र दाखिल करने की अनुमति माँगना एक अलग लड़ाई है जिसे टाला जा सकता है।

दूसरे पक्ष को भी वही देना होता है जो अदालत को दिया — सिर्फ़ प्रिंटआउट देने पर वे हैश जाँच ही नहीं सकते, और फिर वही आपत्ति उठाएँगे कि रिकॉर्ड सत्यापित नहीं है।

जो गलतियाँ सबसे ज़्यादा होती हैं

चैट क्या साबित करती है और क्या नहीं

इसीलिए सबसे मज़बूत दस्तावेज़ वह है जो अपनी सीमाएँ ख़ुद बताता है — कितने अटैचमेंट गायब हैं, कितने संदेश डिलीट के रूप में दर्ज हैं, और जाँचों में क्या मिला। जो दस्तावेज़ चुप रहता है, उसकी चुप्पी दूसरा पक्ष पकड़ता है।
